Wellkempt is a service provided by Byland Ltd. These terms are an agreement between you and Byland Ltd.

What Wellkempt is — and is not

Wellkempt is record-keeping and reminder software for landlords in England. It presents compliance information drawn from a published, versioned rule set. It is not legal advice, and no output of the service creates a solicitor–client or adviser relationship. Legislation changes and individual circumstances differ: for advice on your situation, consult a qualified professional.

Your responsibilities

You remain solely responsible for complying with your legal obligations as a landlord. Wellkempt's obligation statuses are computed from the information you enter; incomplete or inaccurate records produce incomplete or inaccurate statuses. Reminder emails are an aid, not a guarantee — email can fail, and a missed reminder does not transfer any obligation to us.

Liability

To the maximum extent permitted by law, Wellkempt's total aggregate liability arising out of or in connection with the service is limited to the amounts you have paid us in the twelve months preceding the claim (and where you have paid nothing, to £0). We are not liable for loss of rent, loss arising from possession proceedings, regulatory penalties, or any indirect or consequential loss. Nothing in these terms limits liability that cannot lawfully be limited.

Your data

Your records belong to you. You can export everything at any time from Settings, and delete your account (irreversibly) there too. For personal data you record about your tenants and guarantors, you are the data controller and Byland Ltd processes it only on your instructions — see the privacy notice for the details, including how tenant erasure requests are handled without destroying your compliance evidence.

Service

The service is provided as-is. We may change or discontinue features with reasonable notice; if we ever discontinue the service entirely, you will get at least 60 days and a full export. We may suspend accounts that abuse the service. These terms are governed by the law of England and Wales.
